Application for Extension of Status Quo

Application For Extension Of Status Quo Format

Introduction

An Application for Extension of Status Quo is a formal request made to a competent court seeking continuation of an earlier court order directing the parties to maintain the existing state of affairs in respect of a disputed property, possession, or subject matter of the suit.

Such an application is filed when a status quo order is time-bound or about to expire, and the matter has not yet been finally adjudicated. The purpose of extending the status quo is to prevent alteration, dispossession, construction, transfer, or any act that may alter the nature of the dispute, thereby safeguarding the rights of the parties and preserving the subject matter until a final decision is made. Courts generally grant an extension of the status quo where:

  • An extension is necessary to prevent irreparable loss or miscarriage of justice
  • The main case is still pending
  • No fault or delay is attributable to the applicant

Legal Provision

An Application for Extension of Status Quo is usually filed under the following provisions:

  • Order XXXIX Rules 1 & 2, Code of Civil Procedure, 1908
    (Temporary injunctions and interim orders)
  • Section 148, C.P.C.
(Power of Court to enlarge time)
  • Section 151, C.P.C.
(Inherent powers of the Court to meet the ends of justice)

These provisions empower the Court to continue, modify, or extend interim orders, including those maintaining the status quo, to prevent the abuse of the process of law and to ensure fair adjudication.
